Players union 'dissolves;' 2011-12 season in jeopardy

NEW YORK -- For NBA fans who had grown weary of reading about businessmen and collective bargaining and BRI and mid-level exceptions and counterproposals followed by threats backed up by vague ultimatums, the players and the owners officially changed up the dialogue of the league's labor lockout on its 137th day Monday.
Fans will now be reading about lawyers and antitrust allegations and treble damages and the wrong kind of courts altogether, with the 2011-12 season in jeopardy of never getting played at all.
What, you were expecting basketball?

Courtside seats took on a whole new meaning -- and an NBA season of any length was dealt a potentially lethal blow -- when the players chose to dissolve their union and take their fight to court. They will accuse the league's owners and NBA commissioner David Stern of anti-trust violations, with an eye on triple damages -- potentially $6 billion -- as a way of making up for the compensation lost to a damaged and possibly canceled season.

In a meeting of National Basketball Players Association player-reps that lasted almost four hours and was attended by another 20 players, union members in a claimed unanimous show of hands opted to pursue a "disclaimer of interest" strategy. The NBPA immediately dissolved, ending its role as a collective-bargaining agent for a labor contract that, at various times, seemed so close.
Billy Hunter, now the executive director of a "trade association" rather than a union, sent a letter to Stern notifying the owners of the decision. Now, outside counsel Jeffrey Kessler and attorney David Boies -- who, ironically, represented NFL owners when they thwarted the football players' decertification push last spring -- will become the key figures from the players' side, taking over for Hunter and union president Derek Fisher.
So no more long, lengthy labor sessions, with Hunter and Stern staring across a table at each other the way they had for more than 150 hours since the owners imposed their lockout on July 1? "I don't know," Hunter said. "Right now it's about seeking treble damages against the NBA and wiping the slate clean.

"This deal could have been done," he said. "It should have been done. We had given and given and given. And they got to the place where [the owners] just reached for too much. And the players decided to push back. They just thought it was totally unfair. It was more about surrender than it was about [the owners] getting a deal."
The league issued a statement from Stern, alleging that the players planned as far back as February 2010 to "abandon the collective bargaining process and start an antitrust lawsuit against our teams if they did not get a bargaining resolution that was acceptable to them."
It recalled that the NBA on Aug. 2 filed an unfair labor practice charge with the National Labor Relations Board (the union had filed one against the league, too). The league also filed, in the Second Circuit in New York, a pre-emptive lawsuit in federal court charging that the players would use a disclaimer-of-interest as a bargaining tactic. The NBA position is that this move violates labor law because it is intended as a bargaining strategy.

"There will ultimately be a new collective bargaining agreement," Stern said in the statement, "but the 2011-12 season is now in jeopardy."
After a news conference Monday afternoon, Hunter did talk about the possibility of a settlement that, in theory, could still allow for a shortened NBA schedule. The players chose to go the disclaimer-of-interest route rather than decertifying the union, he said, in part to skip the 45-day waiting period after they filed their petition to the NLRB. This starts the clock on the process, Hunter said, with the players' contention that damages -- over such anti-trust violations as the rookie salary scale and the draft -- begin immediately.

Stern, in an interview on ESPN, directed pointed remarks toward Hunter and Kessler; Kessler, for context, is the fellow who referred to the commissioner as a "plantation owner" in an interview last week with the Washington Post. "Obviously Mr. Kessler got his way and we're about to go into the nuclear winter of the NBA," Stern said.
Stern and the owners had sought to deliver the details of their latest offer directly to the players, using tools such as Twitter, a YouTube video and finally a written summary of the proposal emailed to all union members. Included in those terms: A 72-game NBA season that would begin on Dec. 15.
A 0-game season that never begins is more like it now, given the pace at which gears grind through the courts.
Suggesting that a majority of them might not be in favor of this litigation-and-lost-season turn of events, Stern said in the ESPN interview: "If I were a player in the NBA, one of the 450, I would be wondering what it is that Billy Hunter just did."

Hunter and Fisher, however, said this process was begun Monday by the players themselves after the union leaders laid out possible strategies for dealing with the latest offer made by the owners Thursday. It called for a 50-50 split of basketball-related income (BRI), down from the players' 57 percent share in the old CBA, along with restrictions on trades and free-agency for big-spending teams. That offer also apparently underestimated the importance of some so-called "B-list" issues to players, such as two-way contracts for players sent to the NBA Development League and year-round drug testing.

The union listed some possible responses, such as putting the offer to a full-union vote, rejecting it outright or revising six critical "system" issues as a counter-offer (despite Stern's assertions that negotiating was over and a harsher version would be coming next). Hunter said that's when the players inquired about decertification or disclaiming interest.
"I think a lot of it had to do with the fact that there had been in excess of 200 signatures collected from the players to decertify and those 200 signatures were going to be filed tomorrow morning with the NLRB," Hunter said.
In other words, the support was there. And once the topic was raised, Hunter said, "It just snowballed."
Fisher said he felt the players in the room were united in this chosen stance, and he believes rank-and-file players who were not in New York Monday will stand with them. "The floor is always open to all of our guys," Fisher said, surrounded by the 50 players in Monday's meeting, including Kobe Bryant, Carlos Boozer, Elton Brand, Al Horford, Tyson Chandler and others. "Of course guys spoke out, said what they had to say. But still as a group, by the end of the meeting, that the decision that we needed to make."

Se non ricordo male, sarebbe la prima volta, a parte la parentesi bellica, che una stagione di uno sport professionistico non venisse svolta.
Chissa' come sara' la reazione del pubblico.
La NBA potrebbe pagare questa stagione per molti anni, anche perche' da Novembre ad Aprile, prima c'e' il Football e poi l'Hockey quindi non e' che gli americani rischiano di annoiarsi.

Per Chris Paul mancano solo i dettagli, con Gasol che va a Houston e Odom a Charlotte.
Per Howard la trade prevede Bynum in cambio.

David Stern, NBA Commissioner ha annullato lo scambio a tre, in quanto detto scambio avrebbe infranto le regole del nuovo contratto collettivo.
Il nuovo contratto infatti prevede una serie di vincoli che rendono la vita molto dura  alle Franchgie ricche.
Cosi' facendo il campionate riomane bilanciato e ne gode lo spettacolo, quindi piu' soldi dai biglietti.

NBA commissioner David Stern killed the New Orleans Hornets’ trade of Chris Paul after several owners complained about the league-owned team dealing the All-Star point guard to the Los Angeles Lakers, league sources told Yahoo! Sports.

Some owners pushed Stern to nullify the trade and that the Hornets be made to keep Paul on the roster for the foreseeable future, sources said. A chorus of owners were irate with the belief that the five-month lockout had happened largely to stop big-market teams from leveraging small-market teams for star players pending free agency.

The trade between the Lakers, Hornets and Houston Rockets had been consummated late Thursday afternoon, about the same time the league’s owners and players were completing their vote to ratify the new collective bargaining agreement – an agreement that Stern had repeatedly said would help restore the NBA’s competitive balance. League owners had watched last season as some of the game’s biggest stars left for larger markets. LeBron James and Chris Bosh joined Dwyane Wade and the Miami Heat, and Carmelo Anthony forced the Denver Nuggets to trade him to the New York Knicks.

Sports. “In the end, David didn’t like that the players were dictating where they wanted to go, like Carmelo had, and he wasn’t going to let Chris Paul dictate where he wanted to go.”

Before Stern intervened, the Lakers had reached an agreement to acquire Paul in a deal that would have cost them Pau Gasol and Lamar Odom, league sources told Yahoo! Sports. Under terms of the deal, the Lakers would have sent Gasol to the Rockets. The Hornets would have received Odom, Rockets guards Kevin Martin and Goran Dragic and forward Luis Scola, league sources said.

Houston had also agreed to send a 2012 first-round pick – previously obtained from the Knicks – to New Orleans as part of the package, a source said.

Demps had informed two of the other finalists for Paul on Thursday evening that he had a deal in place for Paul to go the Lakers, front-office sources said. All the players involved in the trade have now been told to report to their teams for the start of training camp on Friday.

Hornets general manager Dell Demps is “disconsolate” over the heavy-handed move from the commissioner’s office, a source told Y! Sports. Demps considered resigning his job on Thursday, league sources said, and had to be talked out of it. The Hornets had scored a terrific deal for Paul, a trade that was lauded by some of Demps’ peers throughout the league. Officials involved in the trade talks said the league office was consulted throughout the negotiations, and there was never an indication Demps didn’t have the power to make a deal. In fact, several teams negotiating with New Orleans to get Paul asked the league office, and were told Demps had full authority to execute a trade.

Stern listened to enraged owners on Thursday who insisted this trade went against the entire reason the owners pushed for the lockout, that nothing had changed, and yet it was Stern who made the extraordinary decision to cancel the deal. Demps tried to talk him out of it, league officials said, but Stern was absolute in his desire to kill the trade.

Paul had listed the Lakers as one of his preferred destinations, and it became a more clear choice for him on Thursday after the New York Knicks moved to the brink of completing a four-year, $58 million contract for free-agent center Tyson Chandler. The Knicks lost the salary-cap space they would’ve needed to sign Paul this summer, and the Lakers had been pushing hard to close a deal for Paul with Houston and New Orleans.

As one rival executive with strong ties to the league office said, “Stern cared about two things: Selling that franchise for the best possible price; and showing the players that they weren’t going to dictate where teams could trade them. But now, there’s no way that the league can allow Chris Paul to be traded at all, otherwise Stern is basically deciding where one of the top players in the league is going versus having any fair process.”

Officials from New Orleans, Houston and Los Angeles were stunned Thursday night. The killed trade had ripple affects everywhere in free agency and potential trades, and literally pushed the market into paralysis on the eve of training camps opening up.

“We were all told by the league he was a trade-able player, and now they’re saying that Dell doesn’t have the authority to make the trade?” said an NBA executive who had periodic talks with New Orleans throughout the process. “Now, they’re saying that Dell is an idiot, that he can’t do it his job. [Expletive] this whole thing. David’s drunk on power, and he doesn’t give a [expletive] about the players, and he doesn’t give a [expletive] about the hundreds of hours the teams put in to make that deal.

“How do the Lakers explain this to Odom? How does Houston deal with the guys it just tried to trade? Scola and Martin are going to be pissed at them, and who knows how long that takes to get over? Explain to me how the league kills this Pau Gasol deal, but allows Kwame Brown for Pau Gasol?

“To me, this makes the league feel like it’s rigged, that Stern just does whatever Stern wants to do. He’s messed up the competitive balance of this league a lot worse by killing the deal, because you’ve completely destroyed the planning that New Orleans, Houston did and left them in shambles over this. I’ve never been so discouraged about this league, never so down.

“I mean, come on: Chris Paul is leaving New Orleans in 66 games. He’s gone. And what’s Dell Demps, and that franchise, going to have to show for it?”

Beh magari vista dall'ottica di un tifoso dei fakers  ;D, potrebbe essere così.
Diciamo che con questa trade si liberavano si di due giocatori forti, ma tutti oltre la trentina con contratti pesantissimi e altre agevolazioni a livello contrattuale (complicatissime in NBA) e così avere la possibilità di prendersi, oltre a CP3 (sicuramente il miglior play della lega), anche Howard. Due giocatori fantastici e giovani per due ultratrentenni?
Alle altre 29 franchigie la cosa giustamente non è andata molto giù e hanno costretto Stern, che di fatto aveva gestito l'affare essendo NO di proprietà della NBA (alla faccia del conflitto di interesse  :o), ad annullare la trade.

secondo me i fakers ancora pagano lo scotto del mezzo scippo ai danni di orlando di un certo centro dominante poi nel decennio, uno che si è appena ritirato e che aveva un cognome irlandese: o'neill.
stern vuole giustamente riportare la NBA su basi di maggiore democraticità e di tutela delle c.d. franchigie medie.
si è accorto con un anno di distanza di quanto il passaggio di lebron dai cavs agli heat non sia stato propriamente salutare all'economia della lega.
insomma l'obiettivo è quello di evitare la formazione dei c.d big three rampanti, roba che peraltro da qualche parte c'è ma è in grave degrado fisico (leggasi spurs o celtics).
la ricchezza della NBA è data da franchigie come OKC quale modello da perseguire.
insomma, il modello ... udinese.
agli heat va per adesso sean battier (ex memphis), combattente storico di scuola duke e di mister K, pluridecorato coach da college con record di vittorie appena conseguito e quindi con lo status di icone vivente a stella e strisce.
mi sembra che ny abbia bloccato il centro di dallas (un otitmo intimidatore difensivo), ma non so se è il trade è confermato.
la mossa mi sembra azzeccaata anche perchè amar'e non è propriamente un difensore e carmelo pensa spesso e solo a tirà.

Due giocatori fantastici e giovani per due ultratrentenni?

E' che Stern ha capito che non puo' vincere sempre una squadra della West Conference ;D e cerca di equilibrare, ma tanto non ci riesce e come l'anno scorso avevo detto occhio a Dallas, quest'anno vedo bene Denver

Si, movimenti un pò strani, con L.A. che rafforza di fatto una diretta concorrente al titolo. Qualcosa bolle in pentola.
Anche NY con Chandler diventa sicuramente più competitiva.

I nostri Celtics hanno rafforzato la panchina con gli innesti di Dooling, Bass (tradato con Big Baby), Wilcox e le rifirme di Green e Daniels. Sembra fatta anche per David West da NO, sarebbe veramente un ottimo colpo. Mancarebbe sempre un 5 però.
